<summary type="text">The Bengal Tenancy Act Being Act No. VIII of 1885
The Governor-General  of India
An Act to amend and consolidate certain enactments&#13;
relating to the Law of Landlord and Tenant within the territories&#13;
under the administration of the Lieutenant-Governor&#13;
of Bengal.&#13;
Whereas it is expedient to amend and consolidate&#13;
certain enactments relating to the Law of Landlord&#13;
and Tenant within the territories under the administration&#13;
of the Lieutenant-Governor of Bengal. I have endeavored to arrange the notes in such a way as to make them&#13;
sinful to the Bench and the Bar. * Notes of cases under the old law which are&#13;
11 applicable or which have a bearing on the present law will be found in&#13;
sir appropriate places. I have also cited .some English cases and some'&#13;
portant unreported decisions of the Calcutta High Court which, I expect,f&#13;
11 be found useful. * (&#13;

In one of the appendices at the end will be found a collection of some&#13;
portant rulings on matters such as Resjudicata, Proof of lease, &amp; c . , &amp; c . ,&#13;
lich do not appropriately come under any of the sections of the Bengal&#13;
nancy Act. I thought, however, that these rulings might prove useful to the&#13;
; al profession on questions that often arise in connection with Bengal&#13;
nancy cases. The numerous changes made in the Bengal Tenancy Act by the B. C. Act I|&#13;
1907 and the E. B. A . C. Act I of 1908 have necessitated considerable change^&#13;
the notes 011 the amended sections.; With regard to these as also1 the portion1&#13;
the Act of 1885, which has not been affected by recent legislation, I have&#13;
devoured to make the present edition thoroughly up-to-date by reference to|&#13;
set decided since the publication of the first edition.&#13;
The price lists of staple food crops prepared under s. 39 of the Bengal&#13;
Tenancy Act and published in the local gazettes are of great'importance in the?&#13;
termination of suits for enhancement of rent against occupancy raiyats on&#13;
e ground of rising oil prices of staple food crops; I have therefore on this&#13;
question of some friends, who have great experience in such matters, though&#13;
fit to append in this edition a statement of the prices for the year 1887-1909,&#13;
lich I hope will be found useful.

The Fifth Edition of this book was a reprint of the fourth with an addendum contain. In the present of subsequent cases. In&#13;
the present Edition, all cases up to December 1917 have been incorporated in the body of the book inappropriate places and the long paragraphs of the notes have been further broken up for the convenience of reference. The introduction has not been recast. The Hon. Mr. Kerr does not think however that any revision is n necessary as there have been no changes in the Act since the last Edition was published. The appendices have been carefully recast and bazar rate has&#13;
been added The book has become rather heavy and will admit of a good deal of cond sensation which I hope will be done in the next Edition. I have received material help in the preparation o f this Edition from Baboos Bijay Kumar Bhattacharjee B.L., and Bankim Chandra Mukerjee AT.A., B.L., V kils of the High Court. My thanks are due to them and to the enterprising publishers who have done everything to give the book a creditable got up.
